Streamingo Solutions Private Limited — Terms of Use

By using Streamingo Solutions Pvt Ltd's (the Company) products and services provided either through the company's website or through any other form of delivery, you hereby signify your acceptance of the terms and conditions of service set forth herein. Acceptance of the terms and conditions will also extend to any amendments made thereto, whether specifically notified or not. In the event you are using the Company's Products on behalf of your employer, you will be deemed to have necessary authority to do so and your acceptance of the terms and conditions will be construed as acceptance by your Employer.

Subject to you having registered with the Company as a Validated User and your compliance with these terms and conditions, the company's stated privacy policy as well as applicable domestic and international law, the Company permits usage of its Products for your personal or commercial to the extent permitted by the terms of your registration.

In case you do not agree to these terms and conditions, kindly do not use the Products.

Definitions

The terms "you" and "Validated User" as appearing in this document refer to a customer of the Company who has been pre-authorised by the Company to use its Products, whether or not on a paid basis.

The term "Registration" refers to a process by which a Validated User is provided with a User Name and Password by the Company on its website.

The term "Products" shall include all products, software, services, videos and links to third party websites that are owned or controlled by the Company.

The term "the Company" refers to Streamingo Solutions Pvt Ltd and its branches and associates, wherever situated.

Restrictions on Some Persons

The following categories of persons shall not be permitted to use the Company's products: Those below the age of 18 years and those who are incapable of entering into valid, enforceable contracts, for any reason. Those who are not registered as validated users of the Products or whose registration has ceased to be valid for any reason.

Restrictions on Usage

The Company encourages you to run any video or image through its Products provided you comply with all copyright and other Intellectual Property pertaining to the video or image and the platform on which it is published. You hereby take full responsibility to determine applicable law and comply with such law. The Company takes no responsibility for any violation thereof.

You agree not to run pornographic videos or images or other videos with any kind of objectionable content through the Products.

You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Products and the Company's platform.

The Products are provided to you on AS IS basis. You may access Products for your use as intended by the terms of your registration and subject to all applicable law.

You agree not to circumvent, disable or otherwise interfere with security-related features of the Product or features that prevent or restrict use thereof.

The Company does not endorse any video or image run through its Products by any user.

All Intellectual Property (IP) in the video or image vests with the original owner of the IP and neither Validated User (unless he is the original owner) nor the Company claims any IP on the original video or the video that is the result of having been run through the Company's Products.

Product and Usage

All Products, including their visual interfaces, graphics, design, compilation, information, computer code, software (including any downloadable software) and other elements are protected by Global copyright, patent and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws.

The Company hereby grants you a limited, non-transferable, non-sublicensable, revocable license to (i) use the Products on your computer or other device, subject to you having registered with the Company and complied with all the conditions of the Registration as well as the terms and conditions stipulated here. Unless your terms of registration so provide, you may not distribute or make the products available over a network where they could be used by multiple devices at the same time nor are you allowed to reproduce, redistribute or sublicense the Products.

When you run your videos through our Products, the Company copies the relevant files onto its servers and uses its proprietary software to generate a fresh video. The original video is not edited or added to in any way, and is removed after one day.

Registration and Payment

Before you use the Products, you will need to Register yourself and/or your organization on the Company's platform. You hereby agree that the information you provide on registration and at all other times, will be true, accurate, current, and complete, and that you will keep this information accurate and up-to-date at all times. You agree to take all responsibility relating to your account including the legality or otherwise of all videos that are run though our software from your account, security of your password and other data relating to this account.

The Company will in no way be responsible for loss of the password or unauthorised use of your account.

You will be entitled to run as many videos or images through our software as per the terms of your registration and the Company reserves the right to delete any data that exceeds limits specified. The Company also reserves the right to delete all data upon expiry of the account.

Invoices once raised are payable in full without any deduction. Invoices will include all statutory levies payable by you. Disputes relating to an invoice will be entertained by the Company only after the concerned invoice is paid in full: refunds if any arising out the resolution of such disputes will be made by the Company.

Termination

The company, may at its option terminate any account without assigning any reason therefore if any illegal or objectionable activity is found therein. Consequent upon such termination, all data pertaining to the account shall be deleted without any notice. The Company, may at its discretion report illegalities if any, to the appropriate authorities.

You shall have the right to terminate your account without assigning any reason, subject to fulfilment of the terms of any contract that you may have entered into with the Company and on making full settlement of all dues from you to the Company.

Warranties

Other than offering its Products in consonance with the terms of your registration, the Company does not provide any technical or other support to you. It is your responsibility to ensure that you have the requisite hardware, software, internet connectivity, telecommunication infrastructure and other services that you may need to run your videos through our Products.

The Company does not warrant that you will be able to access or use the Products at the location and times of your choosing and in an uninterrupted fashion. To the maximum extent permitted by law, the Company disclaims all warranties of any kind, whether expressed or implied, in equity or at law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Company does not warrant that the Products will meet your requirements or needs. The Company is in no way responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to the videos run by you through the Company's Products and you hereby specifically agree that you are not entitled to any legal or equitable rights or remedies you have or may have against the Company for any damages or consequences that you may suffer, including consequential damages, if any.

Disputes with Third Parties

If you have a dispute with another user of the Products or any other third party arising in connection with your use of the Products, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

These terms are governed by the laws of India as applicable to the city of Bengaluru.
